South African Companies Tribunal

With a growing increase in exemption applications coming in to the South African Companies Tribunal (Tribunal) from Social & Ethics Committees (SEC), there has been a shift in how the Tribunal deals with such applications. The Tribunal has more recently held that it is not enough for an applicant to merely inform the Tribunal of the nature of its business. The applicant must also describe the nature and extent of its business activities. Even with no employees the public interest requirement must be adequately satisfied in an exemption application.
