AFSA’s new International Arbitration Rules

AFSA’s new International Arbitration Rules, which came into effect on 1 June 2021, are to be welcomed as a practical, relevant, modern, world-class set of rules and could position South Africa at the forefront of arbitrating international disputes!


The new rules -


- make provision for the appointment of an Emergency Arbitrator (in certain appropriate circumstances) who must make his award within 14 days of being appointed;


- strike a good balance between confidentiality and transparency; and


- make provision for the publication of awards in an anonymous format, unless a party objects thereto in writing. This means that a body of jurisprudence will grow in this particular sphere of the law.
